Terms of Use

1. Eligibility

WakeUpPal is rated 4+ and is suitable for all ages. If you are under the age of 18 (or the age of majority in your jurisdiction), you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App. By using WakeUpPal, you represent that you meet these requirements.

2. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your personal, non-commercial use.

3. How the App works

WakeUpPal is an alarm app that requires you to complete a "mission" to dismiss an alarm. Missions currently include solving a math equation, performing pushups, photographing your made bed, and detecting the sky. The math and pushup missions are processed entirely on your device. The sky and bed missions send the camera image to Google's Gemini API in real time to verify completion, as described in our Privacy Policy. Mission detection relies on sensor and image analysis and may not be perfectly accurate in all conditions or lighting.

4. Subscriptions & billing

• WakeUpPal offers an auto-renewing subscription priced at $1.99 per month or $12.99 per year.
• New subscribers may be offered a 3-day free trial. Unless you cancel at least 24 hours before the trial ends, it automatically converts to a paid subscription at your selected price.
• You can cancel during the free trial at any time in your Apple ID settings to avoid being charged. If you purchase a subscription, any unused portion of a free trial is forfeited where applicable.
• Payment is charged to your Apple ID account upon confirmation of purchase.
• Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period at the rate of your selected plan.
• You can manage or cancel subscriptions in your Apple ID account settings after purchase.
• Prices may vary by region and are subject to change; any change applies only to future billing periods.

Except where required by law or by Apple's policies, payments are non-refundable. Refund requests are handled by Apple.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law.
• Use the App in any unlawful manner or to violate the rights of others.
• Interfere with or disrupt the App, its servers, or networks.
• Attempt to circumvent or cheat mission verification in ways that defeat the purpose of the App.

6. Intellectual property

The App and all related content, trademarks, logos, and software are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

7. Health & safety notice

WakeUpPal includes physical-activity missions such as pushups. You participate at your own risk. The App is not a medical or fitness device and does not provide medical advice. Consult a healthcare professional before beginning any physical activity if you have any health concerns. Always be aware of your surroundings — for example, when stepping outside or to a window for the sky-detection mission — and do not use the App in any way that endangers yourself or others.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, that the alarm will sound in every situation, or that missions will be detected accurately every time. You should not rely solely on the App in any situation where failure to wake could cause harm or loss.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed alarms, oversleeping, or reliance on the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your misuse of the App or your violation of these Terms or any applicable law.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by deleting it. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

12. Apple App Store terms

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranties or for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to comply with the Apple Media Services Terms and Conditions when using the App.

13. Governing law

These Terms are governed by the laws applicable in the jurisdiction in which we operate, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts of that jurisdiction, except where applicable consumer-protection laws grant you the right to bring proceedings elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
